1. Do I need to sign an agreement with the broker before viewing a property?

Yes. In Germany, access to commission-based listings requires confirmation of cooperation terms—often handled online.

2. What does a broker agreement include?

It outlines the scope of services, commission fees, duration, and your right to withdraw.

3. What is an exclusive agreement (Makleralleinauftrag)?

This grants the broker exclusive rights to market your property. It ensures full dedication, priority listing, and premium marketing support.

4. Why use a broker instead of selling independently?

You save time, avoid legal errors, increase the likelihood of a better price, and gain full professional support throughout the process.

Commissions & Costs

5. When is the broker commission due?

Upon signing a lease agreement or notarised contract.

6. What if the purchase or rental doesn’t go through?

No commission is charged.

7. What is the standard commission for purchasing property?

Typically 7.14% gross, often split 50/50 between buyer and seller (3.57% each).

8. Does the tenant pay a commission?

Only if they personally commissioned the property search (“Bestellerprinzip”).

9. Does the seller cover part of the commission?

Yes. By law, the seller pays at least 50% of the brokerage fee (since 23.12.2020).

10. Are there additional costs beyond commission?

Yes—such as notary fees, purchase tax, court fees, and occasionally banking fees

11. Does the listed price include all costs?

No. Usually only the purchase price is listed. Additional costs include taxes, notary, court fees, and commission.

12. How do I obtain an energy certificate (Energieausweis)?

I assist in obtaining it. For exclusive agreements, it is often already included.
